1.- DEFINITIONS.

Entrepreneur: natural or legal person who contracts the products offered for a purpose related to their commercial, business, trade, or profession; User: the natural person who contracts the products for a purpose other than their commercial, business, trade, or profession; GCC: General Contract Conditions; Contractor: user or entrepreneur who contracts the products offered.

 

2.- IDENTIFICATION OF THE PARTIES.

On the one-party "A GRATACOS, SAU" hereinafter GRATACOS whose other identifying data contained in the Legal and domain owner www.gratacos.com, hereinafter Website, and on the other party the Contractor who contracts the products offered through the Website.

 

3.- ACCEPTANCE AND MODIFICATION.

The Contractor declares that he has the legal capacity to contract and accepts the full and unreserved adhesion to the General Contract Conditions, hereinafter GCC, in the version published at the time of contracting.

 

4.- OBLIGATIONS OF THE PARTIES.

 

4.1.- Obligations of GRATACOS:

  • Provide services in accordance with the GCC and without breaching the contractual good faith.
  • Make the CGC available to the Contractor and the particular conditions where applicable.
  • Send the Contractor proof or invoice of the contracted products.

 

4.2.- Obligations of the User:

  • Carry out full compliance with the provisions of the GCC.
  • Complete registration forms with accurate and current information. The Contractor will be solely responsible for the veracity and updating of the information.
  • Maintain the confidentiality of the information provided and notify immediately the loss, loss, theft, illegitimate access, as well as their knowledge by third parties.

 

5.- AVAILABILITY OF THE PRODUCTS.

All items are subject to computerized stock management. In case of exceptional unavailability of a product, the Contractor will be informed by email and advised of a new indicative delivery time. In case the product is not finally available, once informed of this point by email, you can receive a product with similar characteristics or cancel the order. In case the stock of a purchased product fails, GRATACOS will notify you of the waiting time until replacement so that you can decide if you prefer to wait or be reimbursed. 

The meters indicated in the online store are those provided by GRATACOS with a tolerance of +-2%.

The tonality of the colors may differ with respect to the photograph provided in the online store and the printed catalog with respect to the original product. The display of colors is very different depending on the type of monitor and settings for brightness, contrast, color gamut, etc.

GRATACOS also reserves the right to modify the tones throughout the year without prior notice due to manufacturing needs, according to the range of colors or improvements requested by clients. Returns are not accepted for these slight changes in shades. For more security, you can order a sample before processing the order.

 

6.- PRICES.

Our prices are expressed in euros. The prices shown are always Retail Prices, with their respective taxes included, but exclude shipping costs which will be added to the total amount of the fabrics purchased at the time of formalizing the order. The Contractor may know the number of such costs at the time of contracting the product.

GRATACOS has the right to cancel or modify the quantities of your purchase at any time, even after you have paid for your order. 

GRATACOS can cancel or modify your order in case of an option due to an error system before it is detected by our programmers (for example a publication of fabric at 0.31 euros when its actual price is 31 euros).

 

7.- PAYMENT METHODS.

You can pay by credit card with total security. We propose different means of payment. You will find below all the necessary information on the different means of payment proposed in Gratacos.

We do not keep credit card numbers for payments. These personal data are sent directly to the banks with which we work, without being able to access them.

At the time of data transmission to the bank, we use an encryption technology that allows all the personal data requested in a transaction, such as a name, address, or credit card number, to be transmitted securely.

 

8.- TRANSMISSION OF RISK AND PROPERTY.

The Contractor acquires ownership of the products at the time of full payment of all amounts, including shipping costs.

The risk of loss or deterioration will be transmitted to the Contractor, when he or a third party indicated by him, other than the carrier, has acquired his material possession. In the event that the Contractor who orders the transport or the chosen forwarder is not among those proposed by GRATACOS, the risk will be transmitted to the Contractor with the delivery of the goods to the forwarder.

These delivery costs are based on parcels with a maximum weight of 5kg.  For heavier parcels, we will inform you at the time you make your order.

We deliver your fabric and accessories in the peninsula in 24/48 hours (working days) from receipt of order. The delivery times are indicative and based on the services of our logistics operators. Shipments to the Canary Islands, Ceuta, and Melilla will have delivery times that can range from 3 to 5 days. Remote areas may have a delay of approximately 1 day over the indicated periods.

Once the order is made, you will receive a confirmation email and as soon as we deliver it to the courier, you will receive another so that you know at all times how and where your order is.

10.- SPECIFIC PROVISIONS FOR THE USER.

10.1.- Procedure, Rights of Cancellation and Withdrawal, and Legal Warranty. 

 

10.1.1.- Procedure.

To exercise the rights of cancellation, withdrawal, and use of the guarantee, the User must contact GRATACOS at +34 93 238 73 50 or shop@gratacos.com

 

10.1.2. - Right of Cancellation.

The User may cancel your order without any cost provided that it is communicated before the order has been made available to the carrier.

 

10.1.3.- Right of Withdrawal.

The User will have a period of 14 calendar days from when he acquires possession of the property to withdraw from the contract without any justification and without any penalty.

The right of withdrawal will be applicable as long as the contracted products are returned under the same conditions (together with their complete original packaging, labels, and together with any accessory related to them), and the purchase invoice is attached. In any case, GRATACOS will determine if these requirements are met.

In case this right is granted, the User will assume the cost for the return of the products, in case of not being granted; the products will be sent freight collect.

The right of withdrawal shall not apply to contracts that refer to the supply of goods made according to the User's specifications or clearly personalized.

 

10.1.4.- Legal Guarantee.

The User has a two-year warranty period from the delivery of the product. The deficiencies caused by negligence blows, use or improper manipulations by the User are not included in this guarantee. Unless proven otherwise, it will be presumed that the lack of conformity that is manifested in the six months after the delivery of the product already existed when the item was delivered.

The legal guarantee includes the following rights for the User:

  • If the product is not in accordance with the contract, the User may choose between requiring repair or replacement of the product, unless one of these two options is objectively impossible or disproportionate to the detriment of GRATACOS. All expenses for the exercise of this right will be free for the User.
  • The price reduction and termination of the contract shall proceed, at the user's discretion, when the latter can not demand repair or replacement and in cases where these have not been carried out within a reasonable time or without major inconveniences for the User. The resolution will not proceed when the lack of conformity is of minor importance.

 

11.- SPECIFIC PROVISIONS FOR THE EMPLOYER.

 

11.1.- Billing and Delivery.

GRATACOS will deliver the invoice by email to the buyer within 30 days of the delivery date.

The buyer must check the good condition of the package with the carrier who, indicating on the delivery note any anomaly that may be detected in the packaging. If later, once the product has been reviewed, the buyer detects any incident such as blow, breakage, signs of having been opened, or any damage caused to it by shipping, the buyer undertakes to notify GRATACOS via email in the shortest period of time. possible and in a maximum of 7 working days from delivery.

 

11.1.2.- Returns.

All the products purchased in GRATACOS may be returned and refunded, provided that the Employer communicates to GRATACOS his intention to return the product (s) purchased within a maximum period of 14 calendar days from the delivery date and that they comply with the rest of the conditions established in this section.

 

Requirements to request an ADM (Merchandise Return Authorization) with free postage:

- You have received merchandise that you have not requested due to our error.

- You have received merchandise with a manufacturing fault such as defects, stains, etc.

- You have received merchandise with the wrong colors.

 

Requirements to request an ADM with postage paid by the Employer:

- You have 14 days from the receipt of your order to return merchandise to us for any other reason.

Prior communication is essential as returns are not accepted for postage due outside of our returns network.

 

The payment of the order will be made through the same method of payment as the original (bank transfer, credit card, or Paypal).

GRATACOS undertakes to make the economic payment of the fabrics within a maximum period of 30 days after receiving the return of the fabrics.

 

Merchandise returns are not allowed:

- Products that have been tampered with.

- Used, washed, stained, damaged products, etc.

- Once 14 calendar days have passed from the date of receipt of the merchandise, we DO NOT accept the return of any type of merchandise regardless of the reason.

- Product samples.

 

12.- NOTIFICATIONS.

GRATACOS designates their address for the purposes of notifications as the one stipulated in the Legal Notice. The electronic mail provided by the User during the registration process will be the one used by GRATACOS in order to carry out notifications. All notifications made in accordance with the procedure indicated will be considered validly made.

 

13.- COMPETENT JURISDICTION.

In case of dispute between the parties, territorial jurisdiction shall correspond, at the User's choice, the address of the latter or the defendant.

In the event that it hires an Employer, in the event of a dispute, territorial jurisdiction shall lie with the Courts of Barcelona.
